1. Agreement to Terms

Welcome to Elevate Publishers ("we," "us," "our"). These Terms and Conditions ("Terms") govern your access to and use of our online courses (including "Publishing Marketers" and other mini-courses), digital products, community, and all related services (collectively, the "Services"), which are hosted on the EzyCourse platform.

By purchasing, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not purchase or use our Services.

2. User Accounts

To access our courses, you must create an account. You agree to:

Provide accurate, current, and complete information during registration.
Keep your account password and login details confidential.
Not share your account with any other person. You are solely responsible for all activity that occurs under your account.

3. Payments, Billing, and Refunds

A. Payments

You agree to pay the fees for the Services you purchase. All payments are processed through our third-party payment processors (Stripe and PayPal). We do not collect or store your full payment card details. All fees are in the currency stated at the time of purchase.

B. Refund Policy

We offer a conditional 30-day money-back guarantee on our courses. To be eligible for a refund, you must meet all of the following conditions:

You must request the refund in writing to [email protected] within 30 days of your original purchase.
You must have completed less than 50% of the total course content.
You must submit proof that you have completed the required work, exercises, or assignments from the initial modules and that the methods did not work for you ("show you did the work").

Refunds will not be granted if you simply change your mind, fail to meet the conditions above, or request a refund after the 30-day period.

4. Intellectual Property Rights

A. Our Content

All content provided as part of the Services—including but not limited to videos, text, graphics, downloadable materials, and software—is the exclusive property of Elevate Publishers and is protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the course materials for your personal, non-commercial use only.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of our course materials. Sharing, "pirating," or illegally distributing our content is a breach of these Terms and will result in immediate account termination without refund and may lead to legal action.

B. Your Content

You retain 100% ownership of your original intellectual property, including your writing, exercises, and assignments that you create and upload ("Student Work").

For Student Work (Assignments): By uploading your Student Work for feedback, you grant Elevate Publishers a limited, royalty-free license solely for the purpose of viewing, analyzing, and providing feedback to you within the scope of the course.
For Community Content (Testimonials): You may choose to voluntarily post content in our community, such as in a "#Wins&Celebrations" channel. By posting in these public-facing channels, you grant Elevate Publishers a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, display, and distribute that content (e.g., as a testimonial) for marketing and promotional purposes, with or without attribution.

5. Community Rules and User Conduct

You must accept and abide by our Community Rules upon joining. As a user of our Services, you agree not to:

Harass, threaten, or abuse other members.
Use hateful, discriminatory, or obscene language.
Post spam, unsolicited advertisements, or self-promote other products or services.
Violate any intellectual property rights (of ours or others).
Share your account login or any course content with non-students.
Engage in any activity that is illegal or disrupts the Services.

6. Termination

We reserve the right to suspend or terminate your account and access to the Services, without refund, if you breach these Terms or violate our Community Rules. A violation of the Community Rules will result in an immediate ban from the community.

7. Disclaimers

Our Services are provided for educational and informational purposes only.

No Guarantee of Results: Elevate Publishers makes no representations, warranties, or guarantees that you will achieve any specific results, such as successful publishing or any particular level of income, from your use of the Services. Your success depends on your own effort, skill, and circumstances.
Not Professional Advice: The content provided in our Services is not intended as, and shall not be understood as, legal, financial, tax, or other professional advice. You should consult with your own professional advisors for advice tailored to your situation.
"As Is" Service: We provide the Services on an "as is" and "as available" basis without any warranties of any kind.

8. Limitation of Liability

To the fullest extent permitted by law, Elevate Publishers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from (a) your access to or use of, or inability to access or use, the Services; or (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

Our total liability to you for any and all claims related to the Services shall not exceed the total amount of fees paid by you to Elevate Publishers.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Italy.

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved exclusively in the Court of Monza, Italy.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our site and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
